Overview & acceptance.
Welcome to PersonAi. These Terms of Service govern your access to and use of the PersonAi website, marketplace, and related services (collectively, "the Service"). By using the Service, you agree to these terms.
If you don't agree with any part of these terms, you may not use the Service. We do our best to keep things clear and fair — but if anything is unclear, reach out at hello@personai.com.
Use PersonAi for legitimate brand, creator, and agency work. Don't try to harm the platform, its personas, or other users. We'll do our part to keep the service reliable and fair.
Your account.
You're responsible for everything that happens under your account. Keep your password secure and notify us right away if you suspect any unauthorized use.
- You must be at least 18 years old to use PersonAi.
- You must provide accurate, current information when creating an account.
- One account per individual or business. Sharing accounts violates these terms.
- We may suspend accounts that show signs of fraud, abuse, or violation of these terms.
Acceptable use.
When using PersonAi, you agree NOT to:
- Use any virtual influencer persona for illegal, harmful, or misleading content.
- Imply that virtual influencers are real human beings in a way that misleads consumers.
- Use personas for adult content, defamation, or political disinformation.
- Reverse-engineer, scrape, or extract data from our marketplace.
- Resell or sublicense personas outside of permitted license terms.
- Build competing marketplaces using our persona kits or visual direction.
When using PersonAi personas in advertising or content, you must follow your local AI disclosure laws and platform policies (Meta, TikTok, etc). We strongly recommend always labeling AI-generated content as such.
Payments & billing.
All payments are processed through Stripe and are charged in USD. By making a purchase, you authorize us to charge your chosen payment method.
- One-time purchases (Starter, Creator, Brand Kit, Custom Build) are billed once at checkout.
- Monthly Content Service is a recurring subscription. Renewals happen automatically until you cancel.
- Prices may change with 30 days notice. Existing subscribers are grandfathered for at least one billing cycle.
- You're responsible for any applicable taxes in your jurisdiction.
Limitation of liability.
PersonAi is provided "as is" and "as available." We don't guarantee uninterrupted service, perfect uptime, or that every persona will perform to specific business expectations.
To the maximum extent permitted by law, PersonAi's total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
Changes to these terms.
We may update these terms from time to time. When we do, we'll:
- Update the "Effective" date at the top of this document.
- Email you a summary of any material changes.
- Give you at least 30 days notice before significant changes take effect.
Continued use of PersonAi after the effective date means you accept the updated terms.
Contact & governing law.
These terms are governed by the laws of the Philippines. Disputes will be resolved in the courts of Manila, Philippines unless local consumer protection laws require otherwise.

What we collect.
We only collect what's necessary to run the service. Here's exactly what we gather and why:

How we use it.
Your data is used to:
- Deliver the personas you purchase
- Process payments and send receipts
- Respond to your support requests
- Send transactional emails (order confirmations, license updates)
- Improve our service through anonymized analytics
- Send marketing emails — only if you opt in
Your personal information is never sold or rented to third parties. Full stop.
Who we share with.
We share data only with carefully selected service providers, all under data-processing agreements:
- Stripe — payment processing
- Supabase — database & file storage
- Resend — transactional email delivery
- Plausible Analytics — privacy-friendly usage analytics
We may also disclose information if legally required (court order, subpoena) — but we'll notify you whenever lawful to do so.
Your rights.
You have the right to:
- Access — request a copy of all the data we have on you
- Correct — update incorrect or outdated information
- Delete — request deletion of your account and personal data
- Port — get your data in a machine-readable format
- Object — opt out of marketing communications anytime
To exercise any of these rights, email privacy@personai.com and we'll respond within 30 days.
Cookies & tracking.
We use a minimal set of cookies and tracking technologies:
- Session cookies — keep you logged in
- Preference cookies — remember your theme and settings
- Analytics — Plausible Analytics, which doesn't use cookies or track individuals
We do not use third-party advertising cookies, retargeting pixels, or social media trackers.
Data retention.
We keep your data only as long as we need it:
- Account data — while your account is active, plus 90 days after closure
- Purchase records — 7 years for tax compliance
- Email logs — 12 months for support purposes
- Analytics — 24 months, fully anonymized
License overview.
When you purchase a virtual influencer persona from PersonAi, you receive a license to use that persona according to the tier you bought. The persona itself remains the intellectual property of PersonAi unless explicitly purchased with full ownership (Exclusive Vault).

What you can do.
With a Creator license or higher, you may:
- Use the persona across all your owned channels (social media, website, ecommerce)
- Run paid ads featuring the persona on Meta, TikTok, Google, and other platforms
- Create derivative content using the provided gallery and persona kit
- Use the persona in marketing campaigns indefinitely (lifetime license)
- Modify backgrounds, wardrobe, and minor visual details for your brand
What you cannot do.
- Sell, sublicense, or transfer the persona to another party (unless you own a Vault license)
- Use the persona to defame, harass, or impersonate real people
- Create adult or sexually explicit content
- Use personas in political campaign advertising without explicit written permission
- Train other AI models using PersonAi-generated visuals
- Claim the virtual influencer is a real person
Non-exclusivity & exclusivity options.
Marketplace personas (Starter through Brand Kit) are exclusive — the same persona may be licensed to other buyers, including potentially in adjacent industries.
If you need exclusive ownership where no one else can ever license the same persona, you have two options: the Exclusive License add-on (+$2,400) for marketplace personas, or applying for a persona through the Exclusive Vault (starting at Custom).
Refund philosophy.
Since persona kits are delivered instantly and as digital downloads, all sales are generally final. That said, we genuinely want you to be satisfied, and there are specific cases where refunds apply.
When refunds apply.
- Custom Build cancellation before draft — 50% refund if you cancel before we share the visual draft.
- Duplicate purchase — full refund if you accidentally purchased the same persona twice.
- Technical failure — full refund if delivery completely failed and we cannot resolve within 7 days.
- Billing error — full refund if you were charged in error.
- Monthly Content Service — pro-rated refund for the unused portion of your current billing cycle (within 14 days of charge).
When refunds don't apply.
- You changed your mind after downloading the persona kit
- You purchased the wrong license tier — we offer upgrades instead
- You don't like the visual direction (Custom Build includes 3 revision rounds for this)
- The persona wasn't a "fit" for your brand after launch
- Custom Build past the visual draft stage
- Vault purchases after concierge call (full deposit applies)
How to request.
To request a refund, email support@personai.com within 14 days of purchase with:
- Your order ID (#PA-XX-XXXX)
- Reason for the refund request
- Any relevant context (screenshots, errors)
We typically respond within 24 hours. Approved refunds are processed back to your original payment method within 5–10 business days.
Vault overview.
The Exclusive Vault offers a different ownership model from the marketplace. Vault personas are application-based, sold once, and then permanently retired from the marketplace.
Once a Vault persona is sold, it is permanently removed from PersonAi. The gallery is taken offline, and we will never sell or license that persona to anyone else.
Application process.
Vault applications are reviewed by hand and may be declined for any reason at our discretion. Applying is free and creates no obligation.
- Review time — within 48 hours of submission
- Approval — followed by a 30-minute concierge call
- Decline — sent within 48 hours, with marketplace alternatives suggested when possible
- Reservation — personas are reserved on first-approved basis
Ownership rights.
Vault buyers receive an exclusive commercial license with the following rights:
- Full commercial use — across all channels, indefinitely
- Retirement guarantee — no other buyer will ever own this persona exclusively
- Limited resale — you may transfer the license to a parent company or successor entity
- Brand protection — we will not produce personas that closely resemble yours
- Concierge support — dedicated strategist for the lifetime of the license
Cancellation terms.
Once a Vault application is approved and payment is processed, cancellation terms are:
- Before concierge call: full refund minus 5% processing fee
- After concierge call: 50% deposit non-refundable
- After kit delivery: non-refundable
